1. Agreement to Terms

By purchasing, downloading, installing, or using Loopsmith, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Loopsmith. These Terms constitute a legal agreement between you and Loopsmith ("we," "our," or "us").

2. License Grant

Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Install and use Loopsmith on your personal devices.
  • Use the application for personal or commercial content creation purposes.
  • Export and publish content created with Loopsmith on any platform.

This license is for a single user. Each license key is tied to one individual. You may not share, resell, sublicense, or distribute your license key or the Loopsmith software to others.

3. One-Time Purchase

Loopsmith is sold as a one-time purchase at the price listed at the time of sale. This includes all features available at the time of purchase and free updates for the current major version. Future major versions may require a separate purchase.

4. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of Loopsmith.
  • Modify, adapt, translate, or create derivative works based on Loopsmith.
  • Redistribute, sublicense, lease, rent, or lend Loopsmith to any third party.
  • Use Loopsmith to create content that violates applicable laws or third-party rights.
  • Remove or alter any proprietary notices, labels, or marks on the software.
  • Use Loopsmith in any way that could damage, disable, or impair the software or interfere with other users.

5. API Key Responsibility

Loopsmith supports integration with third-party AI image generation services (such as OpenAI's DALL-E, Flux, and SDXL) using your own API keys ("Bring Your Own Key" model). You are solely responsible for:

  • Obtaining and maintaining valid API keys from the respective service providers.
  • Complying with the terms of service and usage policies of each API provider.
  • All costs and charges incurred through your use of third-party APIs.
  • The security of your API keys. While Loopsmith encrypts keys locally using your operating system's secure storage, you should not share your device access with untrusted parties.

We are not responsible for any charges, service interruptions, or data processing performed by third-party API providers.

6. Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with Loopsmith for any reason, you may request a full refund within 30 days of your purchase date. To request a refund, contact us at support@loopsmith.io with your order number. Refunds will be processed through LemonSqueezy, our payment processor, and returned to your original payment method.

7. Intellectual Property

Loopsmith, including its code, design, branding, and documentation, is the intellectual property of Loopsmith. Your purchase grants you a license to use the software, not ownership of the software itself. Content you create using Loopsmith belongs to you, subject to the terms of any third-party services used in its creation (e.g., AI image provider terms).

8. Limitation of Liability

To the maximum extent permitted by applicable law, Loopsmith shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of Loopsmith, regardless of the cause of action or the theory of liability.

Our total liability for any claim arising from these Terms or your use of Loopsmith shall not exceed the amount you paid for your Loopsmith license. Loopsmith is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Termination

We may terminate or suspend your license immediately, without prior notice, if you breach these Terms. Upon termination, you must cease all use of Loopsmith and delete all copies from your devices. Sections relating to intellectual property, limitation of liability, and indemnification shall survive termination.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date. Your continued use of Loopsmith after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
